USPTO Alert USPTO achieves key milestone in modernizing Patent Pre-Grant Publication processing  The United States Patent and Trademark Office (USPTO) reached a milestone in its multi-year Patent Publication Program (3P initiative) modernization efforts to reconfigure how the agency publishes patent applications. Yesterday, the agency processed pre-grant publications in-house for the first time, marking a significant achievement in these efforts. As required by 35 U.S.C. §122(b), the USPTO publishes patent applications promptly after the expiration of a period of eighteen months from the earliest filing date for which a benefit is sought. Pre-grant publication of applications implements valuable policy goals including notifying the public about pending applications, facilitating prior art searching, and increasing public access to technical disclosures which in turn promotes innovation. In addition to transitioning publication activities to USPTO-managed systems, the 3P initiative modernizes the secure infrastructure, tools, and procedures needed to efficiently perform essential application processes. It also leverages DOCX filings to enhance patent application publication accuracy, strengthen data integrity, and improve the quality of published records.  Reaching this significant milestone reflects the USPTO's commitment to strengthening the accuracy, security, and resilience of its patent operations. It underscores the agency's focus on operational excellence and ongoing efforts to deliver modern, dependable systems that benefit applicants, examiners, and the global intellectual property community.
