Justice Department Sues State of South Carolina

Today, the Department of Justice filed suit against the State of South Carolina, alleging that the State unnecessarily segregates adults with serious mental illness in adult care homes, in violation of Title II of the Americans with Disabilities Act (ADA) and the Supreme Court's decision in Olmstead v. L.C. Instead of providing community-based services, the State subsidizes stays in segregated facilities, where people are isolated from the broader community. As a result, over a thousand adults with mental illness remain in adult care homes for years, and more continue to enter these facilities each month. To remedy this violation, the lawsuit seeks transition support and access to alternative community-based services.
