An appointment with the U.S. Attorney's Office offers unique and challenging experiences for the highly motivated attorney; an opportunity to work on their own caseload and appear in court. Working in the Civil Division, the Assistant United States Attorney (AUSA) will primarily focus on enforcing the ADA to protect the rights of individuals with disabilities in the Eastern District of Virginia. The AUSA may also enforce other civil rights statutes. The AUSA will be responsible for handling matters from the investigative stage through settlement and/or litigation. The AUSA may also engage in outreach and training activities.
This is a TERM appointment which will be funded for one year from the start date of employment. However, in the event that additional funding is received, this position may be extended, or made permanent, without further competition.
Office of Intelligence - Oversight Section

The Office of Intelligence (OI) of the NSD is seeking experienced attorneys for its Oversight Section. Attorneys in the Oversight Section oversee foreign intelligence, counterintelligence, and other national security activities of the USIC, including activities pursuant to the Foreign Intelligence Surveillance Act (FISA), to ensure compliance with governing authorities and executive branch policies.
To accomplish this mandate, Oversight Section attorneys coordinate with representatives of USIC agencies to conduct reviews of the USIC's national security activities, including the collection, retention, and dissemination of foreign intelligence information. A significant part of the Oversight Section's work involves analyzing large volumes of information to assess the USIC's compliance with procedures governing the United States' foreign intelligence programs. Oversight Section attorneys must possess mature interpersonal skills, as well as the ability to exercise sound judgment and keen focus for extended periods of time. Additionally, Oversight Section attorneys must possess strong analytic skills so that identified issues are fully investigated and resolved.
Oversight Section attorneys must be comfortable delivering training to large groups. Oversight Section attorneys are expected to travel, resulting in the attorney being out of town for up to several (non-consecutive) weeks per year, in order to conduct oversight reviews at USIC agencies and to conduct training during such reviews. Oversight Section attorneys are also engaged in developing policies relating to oversight and compliance matters. In addition to its oversight responsibilities, the Oversight Section also fulfills various reporting obligations, including statutorily required reporting to congressional oversight committees.
To fulfill those obligations, Oversight Section attorneys are responsible for tracking and synthesizing significant amounts of information and for drafting comprehensive reports for Congress. Oversight Section attorneys work closely with other components of the DOJ and with USIC agencies, often in collaboration with the Office of the Director of National Intelligence, to provide guidance on the interpretation and application of governing authorities. The Oversight Section also works closely with OI's Operations and Litigation Sections.

The incumbent is responsible for working effectively and efficiently with other attorneys and staff to assist the Chief and Deputy Chief in carrying out assigned responsibilities in support of the programs of OEO SOU. The incumbent undertakes and completes assignments in accordance with the mission needs of the Unit and Office, and advises managers at various levels on legal and policy issues relating to the sophisticated techniques and sensitive operational matters utilized in carrying out OEO SOU work.
The incumbent reviews Special Administrative Measures (SAM) applications submitted by AUSAs and provides guidance to the field on the SAM process and coordinates the preparation of the SAM with the requesting USAO; the law enforcement or intelligence agency; and with the BOP and/or USMS. SAM are additional restrictions placed on high-risk federal prisoners in violent crime, espionage and terrorism cases, and are designed to limit the inmate's ability to further disseminate classified information, commit acts of terrorism, or cause injury to persons or property. Decisional memos prepared by the Trial Attorney are presented to the Attorney General when the application involves an original SAM request; and decisional memos seeking annual renewal are prepared by the Trial Attorney for consideration by a Deputy Assistant Attorney General.
The incumbent may review S visa applications and Lawful Permanent Resident (LPR) adjustment applications from AUSAs and law enforcement who need assistance ensuring that foreign national cooperators are available to testify and/or assist in significant investigations and/or prosecutions in the United States. The incumbent is expected to provide guidance to the field on the S visa process.
The incumbent provides legal advice to OEO SOU Case Analysts and Supervisory Case Analysts who administer the FedPris program. A FedPris request is an investigative tool used by law enforcement to develop evidence in support of federal prosecutions. FedPris coordinates the use of cooperating federal inmates or the targeting of federal inmates, in the physical or constructive custody of the Attorney General, in covert operations.
The incumbent may process sensitive consensual monitoring (SCM) requests for senior leadership review. The incumbent drafts a decisional memo recommending whether to approve an agency's request to engage in lawful, warrantless monitoring of oral communications involving certain public officials.
