· Serve as legal counsel to the FBI and its employees in regard to civil lawsuits, administrative claims, requests for testimony and documents, representation matters, and related areas.

· Coordinate the defense of civil actions filed against the FBI and its employees under the U.S. Constitution and federal statutes, such as the Mandamus Act, and the Administrative Procedure Act.

· Work closely with the Civil Division of the Department of Justice and the respective United States Attorney's Offices to represent the interests of the FBI and its employees.

· Assist FBI employees in obtaining Department of Justice representation.

· Assist in the defense of FBI employees in depositions, prepare affidavits and declarations in support of motions, manage the civil discovery process, and provide assistance at trial and in post-trial proceedings.

· Handle the FBI's response to civil subpoena matters and provide legal advice concerning FBI potential liability for investigative and other operations.

· Defend the FBI in the most complex types of civil litigation, including cases with a nexus to national security concerns, with minimal supervision

· Provide expert legal advice and opinion to the highest levels of FBI management on all aspects of organizational legal liability risks.

· Develop professional relationships and partnerships with OGC coworkers, other FBI personnel, and representatives of other U.S. Government agencies, in support of the FBI's legal interests and equities.

GS-13:

· Conducts legal analysis, including research, related to national security and cyber operations, including Foreign Intelligence Surveillance Act applications; undercover operational proposals; and the protection of classified information during trials involving national security subjects.

· Reviews, analyzes, and provides input regarding policies and memoranda of understanding related to FBI national security and cyber interests.

· Reviews and comments on legislative matters pertaining to FBI national security and cyber matters. Drafts written guidance for general FBI dissemination and in implementing statues, regulations, executive orders, and Attorney General and ODNI guidance related to national security law.

GS-14:

· Provides guidance on national security and cyber operations, including Foreign Intelligence Surveillance Act applications; undercover operation proposals; and the protection of classified information during trials involving national security subjects.

· Reviews and negotiates policies and memoranda of understandings related to FBI national security and cyber interests.

· Reviews and comments on all legislative matters pertaining to FBI national security and cyber matters.

· Issues written guidance for general FBI dissemination and in implementing statutes, regulations, executive orders, and Attorney General and ODNI guidance related to national security law.

GS-15: In addition to the above duties;

· Provides expert-level advice directly to internal clients in multiple areas in support of international terrorism, counterintelligence, and cyber investigations.

· Maintains a close liaison and a collaborative relationship with FBI attorneys within Headquarters and the Field Offices as well as from the Department of Justice, National Security Division, and United States Intelligence Community.

· For national security and cyber matters, engages in all aspects of the legislative process, including drafting legislation, providing technical assistance to congressional staff, and preparing executive management for congressional hearings.

· Advises on and drafts proposed policies of the FBI with regard to national security and cyber matters, and conducts training for FBI personnel on these issues.

· Providing guidance in the development of internal information management policies and feedback on the rapidly evolving technologies associated with the preservation, collection, processing and review of ESI;

· Providing coordination and support to Agency Counsel and the Discovery Management Section (DMS) on matters relating to discovery, particularly document-intensive cases involving the application of e-Discovery technologies;

· Providing legal advice on all facets of complex and sensitive FBI matters associated with e-Discovery in administrative investigations, civil lawsuits, criminal cases and other legal matters;

· Collaborating with and providing guidance as needed to a team of e-Discovery technical advisors and paralegals;

· Assessing and improving the e-Discovery workflow and internal processes;

· Keeping ahead of changes in the field of e-Discovery and training/informing management, attorneys and the discovery team on changes in the law and e-Discovery practices;

· Developing and directing long-term projects focused on analyzing and improving the administration and delivery of e-Discovery related advise and services; and

· Integrating and advocating for the incorporation of discovery requirements in Bureau policies and practices.

· Coordinating closely with partners in the Information Technology Branch in the advancement of improved technical support, evaluation of tools, and development of best practices;

· Serve as lead Discovery counsel on complex cases and projects with limited supervision; and

· Provide legal advice and opinions to the highest levels of FBI management on all aspects of information governance and discovery issues.

· Defend the FBI throughout all phases of employment litigation, including class actions, pending nationwide before the U.S. Equal Employment Opportunity Commission, the Merit System Protection Board ("MSPB") and in ensuing appeals.

· Defend the FBI in whistleblower retaliation cases.

· Assist in representing the FBI in personnel-related litigation in the federal courts of the United States.

· Provide legal advice and guidance to the highest levels of FBI management on all aspects of personnel-related issues.

Candidates for this position must possess at least five years of substantive experience in employment litigation. Experience defending administrative agencies in federal sector employment cases, including experience practicing before the MSPB, is beneficial.
