Indicted on Mail, Wire Fraud Charges 12/10/2025 07:00 AM EST ABINGDON, Va. – A federal grand jury sitting in the U.S. District Court in Abingdon, returned an indictment in July 2024 charging Bryce Cleveland, the President and CEO of Scalpa, Inc., with mail fraud, wire fraud, and other charges related to Scalpa's selling of skincare products that had not been approved by the U.S. Food and Drug Administration (FDA).Cleveland, 42, of Scottsdale, Arizona, made his initial court appearance in the Western District of Virginia yesterday following his arrest last month. Simpson announced that on December 4, 2025, RODNEY BERRY ("BERRY"), age 43, was sentenced by U.S. District Judge Barry Ashe to 60 months of imprisonment, after previously pleading guilty to Counts One, Six, and Seven of a superseding indictment. Count One charged BERRY with conspiracy to distribute, and possess with intent to distribute, controlled substances, in violation of Title 21 U.S.C. § 841(a)(1); § 841(b)(1)(A); § 841(b)(1)(B); and 846.
