Final rule on changes to replacement of national registrations by international registrations

Trademark Alert USPTO announces final rule on partial replacement of national registrations by international registrations We've published a final rule amending our regulations for replacing national trademark registrations with registered extensions of protection of international registrations under the Madrid Protocol. This final rule will take effect on July 2, 2025. These changes ensure that the USPTO is in compliance with the Madrid Protocol. Specifically, they incorporate an amendment to the Madrid Protocol that went into effect on February 1, 2021. The changes include: Partial replacement allowed: Trademark owners can now request partial replacement of one or more earlier national registrations with a subsequent pending or registered extension of protection. Previously, owners could only request a full replacement. Listing of goods and services required: All requests for replacement must now include a clear and specific list of the goods and services covered by the replacement.
