The Appellate Section is responsible for appeals in all cases handled by an ENRD Section in the trial court. It also handles directly, or coordinates with the USAOs, on appeals in Division cases that were handled by a USAO in the trial court. In addition, the Appellate Section has responsibility for certain petitions for review filed directly in the courts of appeals that seek review of decisions of the Energy and Interior Departments and of the FAA, NRC, STB, and in some instances FERC. The Appellate Section works closely with the Office of the Solicitor General in determining whether to appeal adverse district court decisions, to seek further review of adverse court of appeals decisions, and to participate as amicus curiae in the courts of appeals and the Supreme Court. The Section provides the Office of the Solicitor General with initial drafts of all briefs filed in the Supreme Court in Division cases handled by the Appellate Section. The Appellate Section management consists of a Chief, a Deputy Section Chief, and three Assistant Section Chiefs, who divide the work of the Section by subject matter.
The Deputy Chief position is responsible for work coming from some of the Division's trial sections, assigning cases, and reviewing briefs and memoranda, as well as working with trial sections and client agencies, the Office of the Solicitor General, and the Front Office on issues as they arise. The Deputy Chief also supervises the work of the three Assistant Chiefs and the Senior Litigation Counsel. The Deputy Chief also works on cross-cutting issues, and has responsibility for various administrative matters. Applicants should have considerable litigation and management experience, excellent judgment, and strong writing and editing skills.
As directed by the Section Chief, the Deputy Chief is expected to lead, manage, or otherwise work on a wide range of functions for the Section, including: (1) litigation; (2) program goals and objectives; (3) operational and strategic plans; (4) review of and comment on proposals (legislative, regulatory, and policy-making); (5) deployment and safeguarding of resources (personnel, money, and information technologies); (6) maintenance and fostering of an effective and engaged workforce (including recruitment, professional development, and personnel actions that range from evaluation and promotion to disciplinary actions); and (7) providing advice to the Section Chief and the senior leadership of the Environment and Natural Resources Division.
In carrying out all assigned duties, like any other Section employee, the Deputy Chief would be expected to: treat everyone in a professional and respectful manner in all situations; communicate effectively in writing and orally; act unfailingly with integrity and honesty; attend to his or her own professional self-improvement; and act in conformance with the public interest, under the law.
