Description: The Office of the Attorney General is seeking applicants for the position of Assistant Attorney General to serve as counsel to Maryland 529, an independent State agency that oversees nearly $10 billion in trust assets in college and disability savings plans for approximately 285,000 unique beneficiaries. 

​Maryland 529, which administers the Maryland College Investment Plan, Maryland ABLE, and the Maryland Prepaid College Trust, is overseen by an 11-member Board that includes the Maryland Comptroller, Treasurer, Secretary of Higher Education, Secretary of Disabilities, Superintendent of Schools, Chancellor of the University System of Maryland, or their designees, and five members of the public appointed by the Governor. The Assistant Attorney General advises the Board on matters relating to State and federal laws and regulations affecting the three Maryland 529 programs, as well as compliance with the State's Open Meetings Act and Public Information Act.

 Day to day responsibilities also include advising Maryland 529 staff regarding compliance with applicable plan documents, laws, and regulations governing the three tax-advantaged programs permitted by Internal Revenue Code §§ 529 and 529A.  The attorney assists the Board and staff in reviewing and revising plan documents and marketing materials for compliance with applicable rules and regulations; prepares legal memoranda for staff and the Board on various issues; reviews agency and Board policies; and provides procurement and human resources advice. The attorney may also negotiate investment agreements and side letters with investment managers engaged for the Maryland Prepaid College Trust and perform other duties as assigned.

 The three Maryland 529 programs have third-party program managers, and the attorney will work with staff and attorneys for those managers.  Current program managers include T. Rowe Price Associates, Inc. (Maryland College Investment Plan), Vestwell State Savings, LLC (Maryland ABLE), and Intuition College Savings Solutions, LLC (Maryland Prepaid College Trust).
