The incumbent serves as an Assistant to the Solicitor General. Each of the Assistants to the Solicitor General participates in all aspects of the work of the Office; none of them specializes in any particular subject. Work is assigned primarily on the basis of their availability and background knowledge when a particular matter reaches the Office. The Office primarily performs a reviewing function. Drafts of briefs and other papers filed in the U.S. Supreme Court are usually prepared in the various operating divisions of the Department or by the regulatory agencies. The Assistants review and revise these documents, often substantially rewriting them. The Assistants work on briefs on the merits, petitions for writs of certiorari, jurisdictional statements, briefs in opposition, motions to affirm, papers relating to stays and other emergency relief, and other forms of motion practice before the U.S. Supreme Court. They also make recommendations as to whether the government should seek U.S. Supreme Court review in cases it has lost, whether the United States should appeal to intermediate appellate courts cases it has lost in the trial courts, and whether the United States should pursue rehearing en banc when cases are lost at the appellate level. The Assistants prepare memoranda to the Solicitor General containing such recommendations and also memoranda discussing other legal problems as assigned. The Assistants argue cases before the U.S. Supreme Court—ordinarily, twice per Supreme Court Term after their first Term in the Office, with third arguments allocated by seniority as available.

Office of Tribal Justice (OTJ)

OTJ is seeking an experienced attorney to serve as Attorney Advisor to provide counsel and assistance to the Director and Deputy Director.  OTJ attorneys:  
-Provide advice on significant tribal justice matters and assist in policy and legislative development and review. 
-Provide advice to OTJ leadership on Department components litigating, protecting or otherwise addressing Native American rights and/or related issues.
-Review proposed legal actions submitted by divisions that require OTJ approval or coordination. 
-Perform legal research on assigned questions or law or policy and prepare reports and memoranda.
-Assist in coordinating with attorneys and officials of the Department, other government agencies, and interested parties to provide guidance and advice to ensure compliance with statutory, regulatory and policy requirements. 
-Assist in maintaining liaison with federally recognized tribes, and work with the appropriate federal, tribal, state, and local officials, professional associations, and public interest groups.
-Develop, coordinate and execute special projects as assigned by the Director or the Deputy Director.

Justice Management Division (JMD)

This position reports to a Deputy General Counsel.  However, the incumbent also has significant collaborative interaction with the General Counsel and attorney colleagues in the office.  The work of the attorney selected for this position involves research, review, and analysis of relevant administrative and judicial decisions and other applicable authorities to provide legal advice or opinions to constituent clients to assist them to formulate administrative policy or to make difficult management decisions; providing written advice on the legal ramifications of new or proposed regulations; and reviewing agency policies and procedures to ensure legal compliance, recommending changes, as necessary.  The attorney chosen for this position may have opportunities to conduct or be involved in administrative litigation, including representing JMD in bid protests at the Government Accountability Office, contract disputes at the Civilian Board of Contract Appeals, employment discrimination matters at the Equal Employment Opportunity Commission, personnel and whistleblower matters at the Merit Systems Protection Board, and, as appropriate, to assist litigating divisions and USAOs when JMD matters are in the federal courts. 

OGC's clients include the JMD Procurement Services Staff (PSS).  PSS provides acquisition support to the Department's Offices, Boards and Divisions (OBDs), including the Department's litigating components, and JMD Staffs. PSS administers a broad range of highly sophisticated multi-million-dollar contracts, including Department-wide Information Technology contracts.  The selectee will have opportunities to advise contracting personnel on an on-going basis about Department procurements, including acquisition planning, detailed reviews of solicitation and evaluation documents for source selections, procurement integrity issues, procurement policy, and other contract administration issues.  The selectee may also have opportunities for involvement in cooperative work with attorneys and executives of other components and agencies regarding matters, initiatives, or projects of mutual concern or interagency responsibility, including working closely with the Office of Inspector General with regard to debarments and suspensions.
