Island Creek Mining v. Gary Malcomb, Brief/Memorandum in Support of Motion

Description: The Director argued that the district director's and ALJ's offset calculation was reasonable, in accordance with law, and in accord with the purpose of the BLBA.

Mabel Samons v. National Mines Corporation, Brief/Memorandum in Support of Motion

Description: While the record is not perfect, its imperfections do not present the kind of due process violation that might justify transferring liability to the Trust Fund. All of the documents Petitioner identified as missing from the electronic record are contained in the Appendix. Although the initial claim form is not in the record, that form is not relevant to the issues on appeal.

Samuel Cummings v. Island Creek Coal Co. and Director, OWCP, Brief/Memorandum in Support of Motion

Description: The Director argued that the ALJ must consider all relevant evidence in determining whether the claimant established complicated pneumoconiosis.
