The Consumer Protection Branch is seeking Trial Attorneys to represent the United States in a broad range of criminal and affirmative civil litigation. Charged with safeguarding Americans' health, safety, economic security, and identity integrity, Trial Attorneys at the Branch develop investigations and pursue significant actions throughout the country. In advancing the Branch's mission, Trial Attorneys work closely with U.S. Attorneys' Offices and federal law enforcement partners. Trial Attorneys engage in all phases of discovery and litigation, including using the grand jury and civil investigative tools, preparing appropriate pleadings, and handling motions and trials before U.S. District Courts. Trial Attorneys also have responsibility for coordinating multi-component and international investigations, cases, and initiatives. In addition, Trial Attorneys represent the United States in direct negotiations and discussions with opposing counsel, often related to complex corporate investigations and litigation matters. Areas of enforcement emphasis for the Branch include: the prescription opioid crisis; fraud schemes affecting older Americans, vulnerable populations, and U.S. service members; adulterated and misbranded food, drugs, tobacco, and medical devices; hazardous consumer products; deceptive trade practices; and data-privacy violations.
In addition, Trial Attorneys review and opine on policy matters and legislative proposals related to public health and safety, and advise U.S. Attorneys' Offices on considered prosecutions under the Food, Drug, and Cosmetic Act and other federal laws. Trial Attorneys further have the ability to engage with Department leadership and to participate in training offerings and events.

The Consumer Protection Branch is seeking a Trial Attorney to specialize in representing the United States in a range of civil defensive litigation. Advancing the Branch's mission to safeguard Americans' health, safety, economic security, and identity integrity, the selected Trial Attorney will defend the Food and Drug Administration, Consumer Product Safety Commission, and other consumer protection agencies in district courts throughout the country. This work includes cases challenging, under the Administrative Procedure Act and U.S. Constitution, agency actions related to food, drugs, medical devices, tobacco, and other consumer products, as well as significant agency policies and programs. These cases typically involve complex legal questions regarding the Federal Food, Drug, & Cosmetic Act, the Public Health Service Act, the Tobacco Control Act, and the Consumer Product Safety Act. Recent examples include the defense of: emergency use authorizations related to COVID-19 vaccines; determinations regarding menthol as a characterizing flavor in cigarettes; the approval of genetically engineered salmon; and a rule regarding the importation of prescription drugs. The Trial Attorney will engage in all phases of litigation, representing the United States in court and in negotiations with opposing counsel, and working closely with agency partners.

In addition, the Trial Attorney hired under this announcement will have the opportunity to engage in the Branch's affirmative civil litigation. Working with U.S. Attorneys' Offices and federal law enforcement partners, the Trial Attorney will advance investigations using civil investigative tools, prepare pleadings, and litigate motions and trials. Areas of enforcement emphasis for the Branch include: the prescription opioid crisis, adulterated and misbranded food, drugs, and medical devices; fraud schemes affecting vulnerable individuals; deceptive trade practices and privacy violations; and hazardous consumer products.

As the Assistant Director and Special Matters Coordinator for the Consumer Protection Branch, the incumbent generally will:

  • Supervise attorneys and staff in the handling and litigation of legal privilege matters and filter reviews, including matters that implicate the attorney-client or other privileges.  Advise attorneys and supervisors throughout the Branch on strategic approaches to identifying and handling issues related to privilege at all stages of civil and criminal investigations and litigation.  Handle and supervise filter and privilege-related litigation—including grand jury litigation—that may be necessary to ensure that such litigation is conducted appropriately and effectively.  Coordinate with Department components, partner agencies, and federal law enforcement agencies in the development and implementation of privilege and filter teams.
  • Establish and oversee uniform and efficient Branch policies and practices for information retention, collection, processing, maintenance, review, and production, especially with respect to electronic information.  Work closely with other Department components, partner agencies, and federal law enforcement partners on such efforts.  Serve as the Branch's liaison to the Civil Division's Office of Litigation Support and e-discovery support lab.
  • Supervise and handle litigation involving particularly difficult and complex discovery issues.
  • Design and manage the Branch's record-management system, coordinating with appropriate Department components.
  • Serve as the Branch's Professional Responsibility Officer.
  • Lead appropriate trainings for Branch personnel.
  • Assist and support the Director, Principal Deputy Director, and Deputy Directors by providing input on budget allocation, hiring, personnel actions, technology, administrative issues, and various Department reporting responsibilities.
