ترجمة مقدمة من وزارة الخارجية الأمريكية خلال إيجاز في مجلس الأمن الدولي بشأن السودان والمحكمة الجنائية الدولية بعثة الولايات المتحدة إلى الأمم المتحدة مكتب الصحافة والدبلوماسية العامة 10 تموز/يوليو 2025 شكرا سيدي الرئيس، وأود أن أتوجه بالشكر لنائبة المدعي العام للمحكمة الجنائية الدولية نزهت خان على إيجازها أمام المجلس اليوم وتقريرها بشأن التحقيقات الجارية والملاحقات القضائية التي تقوم بها المحكمة في ما يتعلق بالوضع في دارفور. ونرحب أيضا بزميلنا ممثل السودان. سيدي الرئيس، تواصل الولايات المتحدة التركيز على حل الأزمة في السودان، إذ يمثل النزاع الدائر هناك أسوأ أزمة إنسانية في العالم اليوم استنادا إلى معايير كثيرة. ونحن ندعو الأطراف المتحاربة في السودان إلى وقف الأعمال العدائية، والسماح بوصول المساعدات الإنسانية بلا عوائق إلى مختلف أنحاء البلاد، وحماية المدنيين. إن الدعم الخارجي للأطراف المتحاربة يطيل أمد النزاع، لذا يتعين وضع حد له. وتدعو الولايات المتحدة إلى محاسبة قوات الدعم السريع على الإبادة الجماعية التي يشهدها السودان، إذ قامت عناصرها بقتل رجال وفتيان ورضع حتى على أساس عرقي، واستهدفت المدنيين أثناء فرارهم، وارتكبت أعمال عنف جنسي وحشي بحق النساء والفتيات من مجموعات عرقية أخرى. لطالما كانت الولايات المتحدة داعما قويا لإحقاق العدالة عند وقوع الفظائع والجرائم وستبقى كذلك، إذ يشكل عدم تحقيق المحاسبة منذ عدة عقود أحد أسباب استمرار النزاع في البلاد. وقد سبق لعدة جهات فاعلة رئيسية في النزاع الحالي ولجماعات مرتبطة بها أن شاركت بشكل مباشر في الجرائم التي ارتكبت في دارفور في العامين 2003 و2004، ويعاد اليوم استهداف الضحايا عينها، وبخاصة في صفوف الجماعات غير العربية. وفي هذا السياق يا سيدي الرئيس، من المؤسف بمكان أن المحكمة الجنائية الدولية المسيسة بدرجة كبيرة قد خصصت كامل مواردها وتركيزها لموضوع إسرائيل على الرغم من الفظائع الدائرة في السودان. وتدين الولايات المتحدة بشديد العبارة قيام المدعي العام للمحكمة الجنائية الدولية كريم خان بإصدار مذكرتي اعتقال بحق رئيس الوزراء الإسرائيلي بنيامين نتنياهو ووزير الدفاع الإسرائيلي السابق يوآف غالانت في ما يتعلق بالحرب الدائرة ضد حركة حماس الإرهابية الفلسطينية في قطاع غزة، كما تدين الولايات المتحدة المحكمة على إصدارها مذكرتي الاعتقال. وحتى لو وضعنا جانبا واقع أن قرار المدعي العام للمحكمة الجنائية الدولية كريم خان يقيم تكافؤا أخلاقيا غير مقبول بين المسؤولين الإسرائيليين المنتخبين ديمقراطيا وبين قادة حركة حماس الإرهابية، لوجدنا أن إسرائيل لم تصادق على نظام روما الأساسي الذي أنشأ المحكمة ولم تنضم إليه، كما أنها لم تمنح المحكمة أي اختصاص قضائي. أضيفوا إلى ذلك أن المحكمة الجنائية الدولية سمحت لـ"فلسطين" بالانضمام إلى نظام روما في العام 2015 على الرغم من أنها غير مؤهلة لذلك لكونها ليست دولة ذات سيادة، مما يعد انتهاكا للنظام نفسه. كما تعارض الولايات المتحدة بشكل لا لبس فيه أي إجراءات تتخذها المحكمة الجنائية الدولية ضد الولايات المتحدة أو إسرائيل أو أي حليف آخر لم يوافق على ولاية المحكمة القضائية، كما نتوقع من حلفائنا معارضة أي إجراءات مماثلة. تشكل إجراءات المحكمة الجنائية الدولية سابقة خطيرة وتهدد بانتهاك مبدأ سيادة الدولة، وتقوض عملنا الحاسم في مجال الأمن الوطني والسياسة الخارجية. وتتناول العقوبات الأمريكية حقيقة أن المحكمة الجنائية الدولية قد انخرطت في إساءة استخدام خطيرة للسلطة التي منحتها إياها الدول الأطراف بدلا من السعي إلى إحقاق العدالة. وتؤدي هذه الأفعال المارقة التي تقوم بها المحكمة إلى تقويض سيادة القانون، وتشويه مصداقية المحكمة وغيرها من مؤسسات العدالة الدولية، وإضعاف السيادة الوطنية. سيدي الرئيس، ستستخدم الولايات المتحدة كافة الوسائل المناسبة لحماية سيادتنا وسيادة إسرائيل وأي حليف آخر للولايات المتحدة من الإجراءات غير المشروعة التي تتخذها المحكمة الجنائية الدولية. وشكرا. للاطلاع على النص الأصلي: https://usun.usmission.gov/remarks-at-a-un-security-council-briefing-on-sudan-and-the-icc/ هذه الترجمة هي خدمة مجانية، مع الأخذ بالاعتبار أن النص الانجليزي الأصلي هو النص الرسمي.
